Finsyght Terms of Service

Welcome to Finsyght. These Terms of Service ("Terms") govern your use of the Finsyght platform and services ("Service"). By creating an account or using Finsyght, you agree to these Terms. If you do not agree, do not use the Service.

1. Accounts and Access

• • You must provide accurate, complete information when creating an account and keep it updated.
• • You are responsible for maintaining the security of your account credentials. Notify us immediately at security@finsyght.app if you suspect unauthorized access.
• • You must be at least 18 years old and legally authorized to enter into contracts on behalf of the business entity you register.
• • Each account is for a single business entity. Agency accounts may manage multiple client workspaces as permitted by your plan.

2. Permitted Use

• • You may use Finsyght solely for your own internal business analytics purposes.
• • You may not resell, sublicense, or provide access to the Service to third parties without written permission from Finsyght.
• • You may not attempt to reverse-engineer, decompile, or extract source code from the Finsyght platform.
• • You may not use automated scraping tools or bots to extract data from Finsyght beyond your normal use.
• • You may not use Finsyght to engage in any activity that violates applicable law or third-party platform policies.

3. Third-Party Platform Terms

Finsyght integrates with third-party advertising platforms. By connecting these platforms you agree that:

3a. Google APIs

• • Your use of Google data within Finsyght is subject to the Google APIs Terms of Service.
• • Your use of Google Ads data is additionally subject to the Google Ads API Terms of Service.
• • You represent that you own, control, or are authorized to connect the Google Ads accounts you connect to Finsyght.
• • You must not use Google data accessed via Finsyght for purposes prohibited by Google's policies, including resale of data, building competitor products, or circumventing Google's systems.
• • Finsyght accesses Google API data as a read-only reporting tool and does not modify your Google Ads accounts.

3b. Meta Platforms (Facebook/Instagram)

• • Your use of Meta data within Finsyght is subject to Meta's Platform Terms and Advertising Policies.
• • You represent that you own, control, or are authorized to connect the Meta ad accounts you connect to Finsyght.
• • You must not use Meta data accessed via Finsyght for purposes prohibited by Meta's platform policies.

4. Subscription and Payments

• • Finsyght offers subscription plans billed monthly or annually as described on the Pricing page.
• • Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
• • 14-day free trial: new accounts receive a 14-day free trial. No charge is made during the trial. You may cancel at any time during the trial with no charge.
• • Cancellation: you may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain access until then.
• • Refunds: we do not provide refunds for partial billing periods. If you experience a service outage of more than 24 consecutive hours caused by Finsyght's infrastructure, contact billing@finsyght.app to request a pro-rated credit.
• • Prices may change with 30 days' notice by email. Continued use after the price change takes effect constitutes acceptance.
• • All fees are in USD and exclusive of applicable taxes. You are responsible for taxes in your jurisdiction.

5. Your Data and Integrations

• • You own your data. Finsyght does not claim ownership of your advertising data, business data, or any content you upload.
• • By connecting a platform, you grant Finsyght a limited, non-exclusive license to access, store, and process that platform's data solely to provide the Service to you.
• • Finsyght never sells, rents, or shares your data with third parties for their independent commercial use. See our Privacy Policy.
• • You are responsible for ensuring you have the right to connect the accounts and data sources you link to Finsyght.
• • Upon account deletion, we will delete your data within 30 days, subject to legal retention requirements.

6. Intellectual Property

• • Finsyght and its underlying technology, design, software, and branding are the proprietary intellectual property of Finsyght. All rights reserved.
• • Your feedback, suggestions, and feature requests submitted to Finsyght may be used by us to improve the Service without obligation to you.
• • Dashboard configurations, saved reports, and automation rules you create within Finsyght remain your intellectual property; Finsyght has a license to store and display them as part of the Service.

7. Prohibited Uses

You must not use Finsyght to:

• • Access advertising accounts or data you do not own or have explicit authorization to access.
• • Perform unauthorized write operations on connected platforms (Finsyght is read-only by design; attempts to circumvent this are prohibited).
• • Build competing advertising analytics products using data accessed through Finsyght.
• • Violate any applicable law, regulation, or third-party right.
• • Introduce malware, viruses, or any harmful code into the Service.
• • Conduct load testing, penetration testing, or security scanning of Finsyght's infrastructure without prior written consent.

8. Limitation of Liability

• • Finsyght is provided "as is" and "as available" without warranty of any kind, express or implied.
• • We do not warrant that the Service will be uninterrupted, error-free, or that data from connected platforms will always be accurate or up to date.
• • Finsyght provides analytics and AI insights for informational purposes only. You are solely responsible for business decisions made based on information displayed in Finsyght. This is not financial, legal, or investment advice.
• • To the maximum extent permitted by law, Finsyght's total liability for any claim arising from your use of the Service is limited to the amount you paid us in the 3 months preceding the claim.
• • We are not liable for indirect, incidental, consequential, punitive, or special damages, including lost profits, lost data, or business interruption, even if advised of the possibility of such damages.

9. Indemnification

You agree to indemnify and hold harmless Finsyght, its officers, employees, and agents from any claims, damages, or costs (including reasonable legal fees) arising from (a) your use of the Service in violation of these Terms, (b) your violation of any third-party right or applicable law, or (c) data you provide to or through Finsyght.

10. Termination and Suspension

• • You may cancel your account at any time from account settings.
• • We may suspend your account immediately if we have evidence of a material violation of these Terms, fraudulent activity, or activity that threatens the security of the Service or other users.
• • For non-material violations, we will provide 7 days' written notice and an opportunity to remedy before suspension.
• • Upon termination, your access to the Service ends. Your data will be deleted within 30 days per our Privacy Policy.

11. Governing Law and Dispute Resolution

• • These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.
• • Any dispute arising from these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be resolved by binding arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules.
• • You waive any right to a jury trial or to participate in a class action lawsuit relating to the Service.
• • Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

12. Force Majeure

Finsyght is not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including internet outages, cloud infrastructure failures, natural disasters, government actions, or third-party API downtime (including Google or Meta API outages).

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email and by posting updated Terms here with a new effective date. Your continued use of Finsyght after the effective date of changes constitutes acceptance.
